1. Definitions

Throughout the following Terms and Conditions;

“Terms” refers to Terms and Conditions

“Company” refers to Lamp City Home Lighting

“Website” refers to www.lampcity.com.au

“Content” refers to all text, graphics, user interfaces, visual interfaces, photographs,

trademarks, logos, and computer code.

“Products” refers to the items for sale on the website

“Specifications” refers to Length, Width, Height, Overall Height, Shade Height, Base Height,

Cut Out, Blade Length, Extension Rods, Dimmable, Colour Temperature, Diameter, Beam

Angle, Speed, Warranty, Wattage, Remote Control, Power, Lumens, Reversible, Projection,

Frame Height, Suspension Height, Canopy.

“Colours” refers to Colour, Glass Colour, Blade Colour, Diffuser Colour, Motor Colour, Cord

Colour, Base Colour, Glass Colour, Acrylic Colour, Shade Colour, Frame Colour

2. General

2.1 This website is owned and operated by Stave Nominees Pty Ltd, trading as Lamp City

Home Lighting.

2.2 Lamp City Home Lighting reserves the right to amend these Terms at any time without

notifying you. Any amendment made to these Terms will be set out on this website. It is

your responsibility to check these Terms for amendments. Your continued use of the

Website following the amendments will mean that you accept and agree to the changes.

3. Content and Intellectual Property

3.1 You must not:

a) Copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit

or distribute in any way to any other computer, server, Web site or other medium for

publication or distribution or for any commercial enterprise, without the written

consent of Lamp City Home Lighting.

b) Use our website to participate in activities that breach any laws, regulations,

standards, codes.

c) Tamper with or hinder the operation of the website

d) engage in any illegal, unlawful or fraudulent conduct, and without limitation, you must

not: (i) make fraudulent enquiries and/or requests through our website;

(ii) use another person’s details without their permission or impersonate another

person when using our website;

(iii) create accounts by automated means or under false or fraudulent pretences;

and/or

(iv) use the website to violate the security of any computer or other network;

e) post to or transmit to or attempt to transmit via our website:

(i) any material which interferes with any person or entity, or prevents any person or

entity from accessing, using or enjoying our website;

(ii) any obscene, indecent, inflammatory, pornographic, illegal, unlawful, defamatory,

harassing, threatening, menacing, offensive or otherwise inappropriate material;

and/or

(iii) any viruses, worms, defects, Trojan horses or similar disabling or malicious code;

4. Disclaimer and Liability

4.1 Products in person may differ from those pictured on the website due to scale and

natural variations of colour. Products are shown as accurately as photographic

processes allow, however, these may differ from monitor to monitor as well as differ from

the real-life product.

4.2 There may be some content that contains errors or omissions (including typographical

errors).

a) There may be numerical errors in regards to the specifications and errors in regards

to colours and textures.

b) Some products might be temporarily or permanently out of stock even though they

show availability on the website.

c) We try out best to ensure that all content on the website is accurate, however,

sometimes errors do occur.

d) We do not provide any warranty or guarantee as to the completeness and accuracy

of the information on our website.

4.3 All prices are AUD and all prices are inclusive of GST

5. Click and Collect

5.1 Once you place your order and payment has been processed, you will receive an order

confirmation email.

Once your order is confirmed, please allow 5-7 business days for you order to arrive in

store. If for any reason we encounter an issue with ordering your product, we will contact

you within 48 hours of your purchase being made.

Once your order arrives, we will contact you informing that your order is ready for

collection.

When you come to collect your goods we ask that you please bring your order

confirmation and photo ID.

Upon collection you will be issued with your tax invoice.

6. Returns, Refunds, Warranties

6.1 Lamp City Home Lighting protects you as our customer by following the ACCC

Competition and Consumer Act 2010 (Cth) (“Act”)

6.2 Exchange: You are welcome to exchange any product purchased (unless otherwise

specified) within 30 days of receiving the product. No fees will apply within this time

frame. After this period a restocking fee of 15% of the purchased value will apply. No

exchange will be allowed after three months of purchasing goods. Proof and Identity of

purchase is required for any exchanges.

6.3 Refunds: Under Act you are entitled to a refund if the product purchased has been

received faulty. Goods in this case must be returned immediately to Lamp City Home

Lighting for inspection. Goods returned for refund will be not accepted for any other

reason. A professional electrician must install all products.

7. Account/ Usernames and Passwords

7.1 You must keep your username and password confidential and not disclose your details

to any other person. Nor may you permit any other person to use that username or

password (either for their own use or on your behalf). You are responsible and liable for

any and all transactions undertaken on our website with your username and password

unless you can prove that there has been an external third party hack.

8. Other

8.1 If any clause of these Terms is held to be invalid, void, unlawful or unenforceable, that

clause will be severed from the Terms and it will not affect the validity and enforceability

of the remainder of the Terms.

Returns, Refunds and Warranties

Lamp City Home Lighting protects you as our customer by following the ACCC Competition and

Consumer Act 2010 (Cth) (“Act”)

Exchange: You are welcome to exchange any product purchased (unless otherwise specified)

Warranties: All our products have a warranty either internally or externally. Warranties claims

must be sent with proof of purchase accompanied by qualified licensed electrical contractor

certificate of installation.
